Making a Claim of Copyright Infringement
The Digital Millennium Copyright Act (the “DMCA”) was enacted in 1998 to protect the rights of copyright owners and to address copyright infringement online. A DMCA takedown notice is a formal request asking a person or entity that has used your copyrighted content without permission, whether intentionally or by mistake, to remove it.
DMCA Provisions
Le Canvas Atelier does not condone or authorize any activity on or through our platform or Services that infringes copyright or other intellectual property rights. We will remove any Content or User Content if we are properly notified that it infringes another party's intellectual property rights.
If you are a copyright owner, or an agent acting on behalf of one, and you believe that any Content or User Content infringes your copyright, you may submit a notification under the DMCA by providing our Copyright Agent with the information described below in writing. For further detail, see 17 U.S.C. § 512(c)(3).
Notification of Claimed Copyright Infringement
Please send DMCA notifications of claimed copyright infringement to lecanvasatelier@gmail.com. Your notification must be made in writing and must include the items listed below.
Please note that you may be liable for damages, including costs and attorneys' fees, if you materially misrepresent that material is infringing your copyright. If you are unsure whether your material is protected by copyright law, we recommend that you first consult an attorney.
To help us process your request quickly, please use the following format and include the section numbers:
- Identify, in sufficient detail, the copyrighted work you believe has been infringed.
- Identify the material you claim is infringing the work identified in item 1, including the URL(s) where the allegedly infringing material is located and a description of the specific content you claim is infringing.
- Provide information reasonably sufficient for us to contact you, including, at a minimum, an email address and a phone number.
- Include the following statement: “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. I also affirm that, as the copyright owner, I have a good faith belief that the use of the material in the manner complained of is not authorized by me, my agent, or the law.”
- Provide the signature of the copyright owner, or of a person authorized to act on the owner's behalf. You may submit your notice by email, provided it includes a valid electronic signature.

Counter-Notification to Claimed Copyright Infringement
If a notice of copyright infringement has been filed against you, we and/or the internet service provider (ISP) will attempt to notify you and provide a copy of the notice. If you have a good faith belief that you have been wrongfully accused, you may file a counter-notification.
If we and/or the ISP receive a valid counter-notification, the DMCA provides that the removed or blocked material will be restored, or access re-enabled, in not less than 10 nor more than 14 business days following receipt of the counter-notification, unless we or the ISP first receive notice from the complaining party that they have filed a court action seeking to restrain the alleged infringer from engaging in infringing activity relating to the material on this website.
